Department of Labor Seeks Delay of Fiduciary Rule Implementation Until July 2019

The U.S. Department of Labor has moved to delay implementation of three exemptions of the “fiduciary rule” until July 2019. The regulation, which partially went into effect earlier this year, requires financial advisers to put retirees’ interests ahead of their own when providing investment advice regarding the customers’ retirement accounts. The provisions impacted by the delay include what is known as the “best interest contract” exemption, a requirement mandating advisers and financial institutions sign contracts agreeing to put their clients’ interests ahead of their own before servicing such clients. The best interest contract exemption would also allow investors to bring class-action lawsuits against advisers and financial firms.  The Department of Labor has sought to postpone implementation of the principal transactions exemption and amendments to the prohibited transaction exemption 84-24 as well. Under a 2016 Final Rule, the Department of Labor (DOL), under the Obama administration, pushed federal regulations under the Fair Labor Standards Act (FLSA) that would have more than doubled the “threshold” under which nearly every salaried employee would be entitled to overtime. In November 2016, a federal district court prevented the new threshold from coming into effect, and the subsequent election of President Trump called into doubt whether revised rules would ever be implemented. DOL Updates Federal Contractor Regulations Prohibiting Sex Discrimination for First Time Since 1970

On Tuesday, the U.S. Department of Labor announced a final rule to expand sex discrimination guidelines for federal contractors and subcontractors. The final rule updates—for the first time in over 40 years—the Office of Federal Contract Compliance Programs' sex discrimination regulations to align them with current interpretations of Title VII of the Civil Rights Act of 1964 and the realities of today's diverse workforce. Department of Labor's Persuader Rule Convinces No One

Late last month, the Department of Labor published its "persuader" regulation final rule, which significantly strengthens a union's rights under the Labor Management Reporting and Disclosure Act ("LMDRA"). 

Generally, the LMDRA regulates the public reporting obligations of businesses seeking legal and non-legal counsel to oppose or manage relations with unions. A consultant, known as a "persuader," helps an employer navigate organizing drives and labor disputes. Before this final rule, The LMDRA required "direct" persuader activities to be reported, such as meetings between the persuader and employees, but exempted "indirect" activities, such as the preparation of materials for the employer to provide to its employees. DOL may Require Federal Contractors to have 7% Disabled Workforce

The Department of Labor yesterday announced a proposal to require all federal contractors to set a hiring goal of a labor force with at least 7% disabled workers. The Department already requires federal contractors to provide equal employment opportunities to individuals with disabilities, but this would be the first time that the Department would identify a strict numerical goal for contractors' disabled hiring. "Having trouble keeping track of your hours at work? The U.S. Department of Labor has an app for that! The first DOL application for smartphones is a timesheet to help employees independently track the hours they work and determine the wages they are owed. In English or Spanish, users can track regular work hours, break time and any overtime hours for one or more employers. This information could prove invaluable during a Wage and Hour Division investigation when an employer has failed to maintain accurate employment records. "This app will help empower workers to understand and stand up for their rights when employers have denied their hard-earned pay," said Secretary Solis. The free app is currently compatible with the iPhone and iPod Touch.
